TERMS OF USE OF WEBSITE

This Website is owned by Espresso Engineers Limited (“we” or “us”), a New Zealand registered company of 28 Crummer Road, Grey Lynn, Auckland, 1021, New Zealand.

This Website is intended for persons located in New Zealand only. The laws and jurisdiction of New Zealand exclusively apply to any purchases, payments and other transactions and made through the Website; information on the Website and information collected about Website users and purchasers. Any disputes or claims will be governed by New Zealand laws in New Zealand courts.

We can modify our Terms and Conditions at any time, and the current version will always be that which is posted on our Website. You are responsible for reading the Terms and Conditions from time to time in order to familiarise yourself with any changes.

All content of this Website including text, brand names, logos, diagrams, photographs and designs is protected by copyright, trademarks or other intellectual property belonging to us or to or third parties who have authorised us to use their intellectual property. No user is permitted to copy or use or reproduce any of the content of this Website other than as strictly necessary to use the Website for legitimate purposes such as ordering products, making payments or referring to information.

Use of the Website is at your own risk. We do not guarantee your use will be uninterrupted, timely, secure and free of error. We are not liable for any damage or virus which could affect your computer, other devices, systems, files and information due to your access to, use or downloading of any material from the Website.

The Website may contain hypertext links leading to other websites that are not operated or controlled by us. We are not responsible for these sites and have no responsibility or liability in relation to their content, legality, accuracy or functions. If you choose to select a link to a third party website or social media account or other internet location you do so entirely at your own risk.

THE PRODUCTS AND PURCHASES

  1. PRICE AND DELIVERY

Reference to a product or service on the Website is not a guarantee that such product or service is available.

We reserve the right to refuse orders for any reason. Your order only becomes a binding contract when we have confirmed it is accepted.

Payment is required at the time of purchase. No products will be delivered prior to payment being made in full.

All product prices displayed on the Website include GST unless specifically stated as GST exclusive.

Tracked courier delivery is included in the product price. All deliveries must be signed for. It is your responsibility to ensure someone is at the delivery address to accept and sign for the products, or to provide us with an alternative delivery address when placing your order where you can collect the product or ensure someone is available to accept delivery. You will be responsible for costs of any additional attempts or alternative methods of delivery if it is not achieved at your stated delivery address for any reason.

We may update product and delivery prices at any time. If you start an order but do not complete the purchase or payment before a price is changed; the prices displayed on the Website at the time you make payment will apply.

We use our reasonable endeavours to ensure the products are delivered in a timely manner but we are not responsible to you or liable for any loss you may suffer due to delayed or late delivery for any reason beyond our direct control.

Once you have made an order and it has been accepted by us you are not entitled to cancel the order, or to return the products if you change your mind. 

  1. PRODUCT WARRANTY

Espresso Engineers is not the manufacturer of any of the products we sell through the Website. Some manufacturers provide their own warranties with the products. These warranties apply to all purchasers. They do not transfer to any subsequent owner or user of the products. Any claim under the manufacturers warranty must be notified to us or the manufacturer with proof of purchase within the warranty period.

Espresso Engineers provides warranty cover for products to purchasers as required under the Consumer Guarantees Act 1993. Our Consumer Guarantees warranty period for the products is 12 months from date of purchase. Full details of any claim must be notified to us within the warranty period with proof of purchase.

Consumer Guarantees warranties do not apply to purchasers that are businesses purchasing the products for resale or commercial use.

The cost of return of products to base for warranty purposes shall be paid by the purchaser.

The cost of any initial inspection or testing of products necessary to establish a fault or cause of problem will be payable by the purchaser if the fault or problem is not covered by warranty.

Purchasers of coffee machines and grinders must complete any training offered by Espresso Engineers, and/or properly review instructions and manuals supplied by the manufacturer or Espresso Engineers to ensure proper use and care of the products.

All maintenance and repair of coffee machines and grinders must be carried out by Espresso Engineers or by properly trained and experienced technicians authorised or approved by Espresso Engineers.

Products faulty on Receipt:

  • If you discover the products as delivered do not meet the description of the products you ordered, or they are faulty or damaged you must inform us of the problem within 7 days of receiving or opening the products and follow our instructions about what to do next.
  • You must not use or further handle or attempt to repair the products until we have inspected them.
  • If you do not advise us within the 7 day period or do not follow our instructions after advising us we will not have any obligation to fix the problem unless it can be proven the products are in exactly the same condition as when they were first delivered.
  • In any event, no claim for failure to meet description or fault or damage on delivery will be accepted more than 21 days after delivery.

Manufacturer and Consumer Guarantees warranty claims will not be valid:

  • If the damage or other problem is caused by owner misuse, lack of cleaning, care or basic maintenance as required under product instructions or lack of skill due to failure to complete training or follow instructions;
  • If the item has been repaired or maintained at any time by any technician not approved by Espresso Engineers;
  • For replacement or repair of parts due to normal wear and tear during normal use;
  • Where not notified within the warranty period.

 

DATA COLLECTION AND USE

  1. PRIVACY STATEMENT

When you order products or make enquiries through this website or communicate with us through email, by phone or on paper we collect personal information provided by you, including your:

  • name
  • contact and delivery address
  • billing and payment information

We collect your personal information in order to:

  • Sell and deliver the products you order from us,
  • Follow up on order status,
  • Keep records of the purchase to assist with any future repair, service or performance requests,
  • Have details of purchases for warranty records and claims,
  • Place you on our customer mailing list to send you promotional or information communications from time to time about your purchase or other products and services that may be helpful to you,
  • Other legal and administrative purposes related to our business of promoting and selling our products and services.

For the purpose of processing sales and deliveries, storing your information electronically, and product warranties; we sometimes need to provide all or parts of your personal information to:

  • Payment and billing service providers;
  • Product manufacturers, distributors, service technicians;
  • Suppliers of administration and data processing and storage services (“cloud” data services).

If we sell our business, all customer and purchase information will be supplied to the purchaser as the new owner for the same and similar purposes.

If you prefer not to enter all the required information on our order forms, we may be unable to sell products to you through this website.

You have the right to ask for a copy of any personal information we hold about you, and to ask for it to be corrected if you think it is wrong. You also have a right to ask us not to send you any promotional or information communications.

If anything happens that could compromise the privacy and security of your non-public information, we will use our best endeavours to minimise any unauthorised use or sharing of your information and will contact you to advise of the situation. However, we will not be liable to you or anyone else for any loss or unauthorised use of information due to circumstances due to third party acts or omissions.
